Statutory Review of Motor Dealers and Repairers Act 2013




As you would be aware, MTA NSW has been lobbying and working with the NSW Government since mid-2018 to introduce improvements to our Industry. This was done through the Better Business Reforms package (BBR) and the announcement of the statutory review for the Motor Dealers and Repairers Act 2013.

 MTA NSW has been successful in its push to have the Motor Dealers and Repairers Act 2013 reviewed and MTA NSW is pleased to advise our Members that this long-awaited review will commence in March with a timeline as follows.

  • March 2020 - discussion paper sent to key stakeholders
  • May 2020 - draft report sent to NSW Parliament
  • July 2020 - report sent to NSW Cabinet
  • December 2020 - final report presented to NSW Parliament

The BBR has brought about a lot of change to the industry such as: Location Restrictions Lifted for Dealers (implemented February 2020); modernisation of the Uncollected Goods Act (to be implemented by July 2020); exemptions for Tow Truck service technicians giving them the ability to road test vehicles without a Tow Truck authority (waiting on the Revised Tow Truck Regulation to be released) and most importantly, the re-introduction of Certificate II qualifications (as restricted licencing).

MTA NSW is working with the relevant Ministers office to try and get these implemented through the regulatory avenue rather than a review process but this will be dependent on the Parliamentary Councils Office time frame.
